INTELLECTUAL PROPERTY
OLDSMOKE™ places particular importance on the protection of its design language, visual identity and original product concepts.
The design of each OLDSMOKE™ product is conceived as an original expression of the brand’s creative direction.
Where applicable, individual product designs are protected through registration with the European Union Intellectual Property Office (EUIPO) as Registered European Union Designs.
Such registration grants the holder exclusive rights in the protected design throughout the European Union and enables action against unauthorized use of designs that fall within the scope of that protection.
OLDSMOKE intends to pursue the registration and protection of future product designs as part of its ongoing intellectual property strategy. Each product is developed as a distinctive OLDSMOKE™ creation, reflecting the personal design language and creative signature behind the brand.
The form, proportions, contours, visual composition, surface treatment and overall appearance of an OLDSMOKE™ product are not regarded merely as functional elements, but as integral components of its design identity.
Where registered design protection applies, reproduction, manufacture, offering for sale, commercial distribution, importation, exportation or other unauthorized use of the protected design may constitute an infringement of the rights of the registered holder.
OLDSMOKE TRADE MARK
OLDSMOKE™ is used as the identifying trade mark of the brand.
Where the OLDSMOKE™ trade mark is registered, the corresponding trade mark rights are reserved to the registered proprietor within the scope of the relevant registration, including the goods and services for which protection has been granted.
No third party is authorized to use the OLDSMOKE™ name, logo or confusingly similar signs in a manner that infringes applicable trade mark rights or creates an unauthorized association with OLDSMOKE™.
